PATINE – Terms of Service
1. General
These Terms of Service apply to all offers, orders and agreements made through the PATINE webshop and any purchases made directly with PATINE.
By placing an order, you confirm that you have read and accepted these Terms.
PATINE reserves the right to update these Terms at any time. The version published on our website at the time your order is placed shall apply to your purchase.
2. Products
PATINE carefully curates vintage, antique and handcrafted objects sourced from around the world. Many of our products are unique and cannot be replaced.
Because of their handmade or historic nature, no two objects are exactly alike. Variations in colour, dimensions, texture, finish, shape and appearance are natural characteristics that contribute to the authenticity and individuality of each piece.
Product photographs and descriptions are prepared with great care. However, colours may vary slightly depending on lighting conditions and screen settings. All dimensions are approximate.
Adding a product to your shopping cart does not reserve that item. An order is only confirmed once payment has been successfully received.
3. Vintage & Antique Objects
Our collection consists largely of objects that have lived a previous life.
Patina, wear, scratches, chips, repairs, hairline cracks, colour variations, surface irregularities and other signs of age are authentic characteristics that reflect the history of each object. These features should not be regarded as defects but as part of the beauty and uniqueness of vintage craftsmanship.
Every object is individually inspected before being offered for sale. Unless stated otherwise, all vintage and antique items are sold as is.
Historic repairs may be visible and are considered part of the object's character rather than imperfections.
4. Living Plants
PATINE carefully selects every plant with attention to quality and health.
As living products, plants naturally vary in shape, size, colour, foliage and growth habit. Seasonal changes and natural development may cause the delivered plant to differ slightly from the photographs shown on our website.
Once a plant has been delivered or collected, its care becomes the responsibility of the customer.
PATINE cannot be held responsible for deterioration, leaf loss, disease, frost damage, pest infestations or plant death resulting from incorrect care, environmental conditions, improper planting, transportation after collection or circumstances beyond our reasonable control.
Please inspect your plant immediately upon arrival. Any concerns regarding its condition must be reported within 24 hours of delivery and accompanied by clear photographs.
Due to their perishable nature, living plants are generally excluded from returns, except where required by applicable consumer law.
5. Natural Materials
Many PATINE products are made from natural materials including terracotta, natural stone, reclaimed wood, metal and other naturally occurring materials.
Natural variations in colour, texture, grain, porosity, density and finish are unavoidable and form part of the product's character.
Over time these materials may naturally weather, oxidise or develop additional patina. Such changes are normal and should not be considered manufacturing defects.
6. Outdoor Use
Not every PATINE object is suitable for outdoor use.
Only products specifically described as suitable for outdoor use should be placed outside.
To preserve the quality and lifespan of your object, we strongly recommend:

Always using an inner pot or waterproof liner.

Never planting directly into the object.

Preventing standing water.
-
Protecting the object from prolonged frost whenever possible.
Most vintage and antique pottery is not waterproof.
Exposure to constant moisture, standing water, frost or filling an object entirely with soil may create internal pressure that can lead to cracks or breakage over time.
If you require a drainage hole, this must be requested before your order is shipped. PATINE will drill a drainage hole where technically possible. Once drilled, the object cannot be restored to its original condition.
Damage resulting from frost, standing water, incorrect planting, lack of drainage, weather conditions or improper outdoor use is not covered.
7. Care & Maintenance
Customers are responsible for using and maintaining purchased products appropriately.
Care instructions provided by PATINE should always be followed.
Improper use, incorrect installation, neglect or failure to maintain a product may shorten its lifespan and is not considered a product defect.
8. Shipping
Every order is carefully packed using suitable protective materials to ensure it arrives safely. As many of our products are vintage, antique or fragile, shipping always carries a degree of risk.
For particularly valuable, fragile or oversized objects, we recommend collection from our showroom or the use of specialised transport whenever possible.
Delivery times are estimates only and cannot be guaranteed. PATINE is not responsible for delays caused by carriers, customs procedures or circumstances beyond our reasonable control.
Upon delivery, customers should inspect their order immediately.
If your order arrives damaged, please notify us within 48 hours of delivery and include clear photographs of:

the damaged product;
-
the inside of the packaging;
-
the outside of the packaging;
-
the shipping label.
This information enables us to investigate the claim with the carrier. Claims submitted after this period may not be accepted by the shipping company.
9. Collection
Orders may be collected by appointment from the PATINE showroom.
Customers are responsible for inspecting their order before leaving the showroom.
Once an order has been collected, responsibility for the safe transport, handling and installation of the purchased items transfers to the customer.
10. Returns
If you are a consumer residing within the European Union, you may have the legal right to cancel your purchase within the applicable statutory withdrawal period, unless an exception applies under applicable law.
To exercise your right of withdrawal, please contact PATINE before returning your order.
Returned products must:
-
be returned within the applicable return period;
-
be carefully packaged;
-
be complete and in the same condition in which they were received;
-
include all original accessories where applicable.
Return shipping costs are the responsibility of the customer.
Because pottery and fragile objects are often excluded from standard courier insurance, customers remain responsible for ensuring returned goods are packaged appropriately and shipped safely. Damage occurring during return transport may result in a reduced refund where permitted by applicable law.
The following products are generally not eligible for return unless required by law:

living plants;
-
custom-made products;
-
products modified at the customer's request, including objects with a drilled drainage hole.
Refunds will be processed after the returned items have been received and inspected.
11. Sustainable Packaging
Sustainability is an important part of PATINE.
Whenever possible, we reuse clean, strong and suitable packaging materials to reduce unnecessary waste while maintaining a high standard of protection during transport.
Whether new or reused materials are used, every order is packed with the same care and attention.
12. Intellectual Property
All content published by PATINE, including but not limited to:

photographs;
-
product images;
-
product descriptions;
-
website content;
-
logos;
-
branding;
-
graphics;
-
designs;
-
marketing materials;
remains the exclusive intellectual property of PATINE unless stated otherwise.
No content may be copied, reproduced, published, distributed, modified or used, in whole or in part, without our prior written permission.
Unauthorised use of our photographs, product descriptions or other content may result in legal action.
13. Limitation of Liability
PATINE takes great care in sourcing, describing, photographing, packaging and delivering every product.
To the fullest extent permitted by applicable law, PATINE shall not be liable for damage resulting from:

improper handling or installation;
-
accidental impact;
-
misuse;
-
incorrect planting;
-
failure to use an inner pot or waterproof liner;
-
inadequate drainage;
-
standing water;
-
frost or freezing temperatures;
-
weather conditions;
-
natural ageing of materials;
-
failure to follow care instructions.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the Netherlands.
Any dispute arising from these Terms or any agreement between PATINE and the customer shall be submitted to the competent Dutch court, unless mandatory consumer protection legislation provides otherwise.
